INTRODUCTION
These Terms of Service ("Terms") govern your access to and use of the services, including any content, functionality and products offered on or through the websites, mobile applications and other online services provided by Exciting Travel Holidays Private Limited (the "Company"), a company registered under the laws of the Republic of Maldives with Registration No. C-0288/2012, having its registered office at 11204 1st Floor, Nirolhu Magu, Hulhumalé, 23000, Maldives.
By accessing or using the Company's services, you agree to be bound by these Terms and our
Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Company's services.
ABOUT THE COMPANY
Exciting Travel Holidays Private Limited is a destination management company (DMC) based in the Maldives, providing travel and tourism services, including hotel bookings, transfers, excursions, and other related services to tourists visiting the Maldives. The Company operates as a business-to-business (B2B) service provider, facilitating bookings and arrangements for its partners worldwide, who, in turn, offer these services to their business-to-consumer (B2C) customers.
USE OF SERVICES
The Company's services are intended for use by individuals and businesses seeking to book travel and tourism services in the Maldives. By using the Company's services, you represent and warrant that you are of legal age to form a binding contract with the Company and that all information provided by you is accurate and up-to-date.
You are responsible for maintaining the confidentiality of your account information, including your username and password, and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.
PAYMENTS AND FEES
The Company may charge fees for its services, which will be disclosed to you prior to confirming any bookings or transactions. You agree to pay all applicable fees and charges incurred in connection with your use of the Company's services.
The Company reserves the right to modify its fees and pricing structure at any time, effective upon posting the modified fees on its website or providing you with other reasonable notice.
INTELLECTUAL PROPERTY
The Company's services, including but not limited to text, graphics, images, logos, software, and other materials, are protected by copyright, trademark, and other intellectual property laws. You acknowledge and agree that the Company retains all intellectual property rights in and to its services, and you shall not acquire any ownership rights in or to the Company's intellectual property.

You agree to use the Company's services only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict or inhibit their use and enjoyment of the services. You shall not engage in any activity that disrupts or interferes with the Company's services or servers or networks connected to the services.
The Company reserves the right, in its sole discretion, to terminate or suspend your access to its services, without prior notice, for any reason, including but not limited to a violation of these Terms.

The Company's services may contain links to third-party websites or resources. The Company does not endorse or assume any responsibility for the content, privacy policies, or practices of such third-party websites or resources. You acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such third-party content, products, or services.
DISCLAIMER OF WARRANTIES
The Company's services are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
The Company does not warrant that its services will be uninterrupted, secure, or error-free, or that any defects will be corrected. You acknowledge and agree that your use of the Company's services is at your sole risk and discretion.
LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the Company's services, whether based on contract, tort, strict liability, or any other theory, even if the Company has been advised of the possibility of such damages.
In no event shall the Company's total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing or using the Company's services.
INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with your access to or use of the Company's services, your violation of these Terms, or your violation of any rights of another.
GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the Republic of Maldives, without giving effect to any principles of conflicts of law.
Any dispute, controversy, or claim arising out of or relating to these Terms or the Company's services shall be resolved through binding arbitration administered by a recognized arbitration institution in the Maldives, except that either party may seek equitable relief in court to prevent imminent harm pending the resolution of the arbitration.
GENERAL PROVISIONS
These Terms constitute the entire agreement between you and the Company regarding your access to and use of the Company's services and supersede any prior agreements or understandings, whether written or oral.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The Company may assign or transfer these Terms, in whole or in part, without restriction.
No waiver by the Company of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
